Terms of Service
1. Introduction
1.1. Please read these Terms of Service carefully. By using the Service (as defined), you agree that you have read and understood the terms in these Terms of Services which are applicable to you. These Terms of Service and the DUDU CAR Policies (as defined) constitute a legally binding agreement (“Agreement”) between you and DUDU CAR (as defined). The Agreement applies to your use of the Service (as defined) provided by DUDU CAR. If you do not agree to the Terms of Service, please do not use or continue using the Application or the Service provided by DUDU CAR.
1.2. DUDU CAR reserves the right to modify the terms of this Agreement at any time. Any changes will take effect once they are published on website or within the Application. You are responsible for regularly reviewing the Terms of Service. By continuing to use the Service after any amendments are made, whether or not you have reviewed them, you are deemed to have accepted and agreed to be bound by those changes..
1.3. DUDU CAR is a technology company that provides a platform for consumers to receive transportation services offered by the Drivers. All responsibilities for services lies with the respective drivers. Drivers are independent entities and shall not present themselves as agents, employees, or representatives of DUDU CAR.
2. Definitions
In these Terms of Service, the following words shall have the meanings ascribed below:
2.1. “Application” means the relevant mobile application(s) made available for download by DUDU CAR (or its licensors) to Consumers and drivers respectively;
2.2 “Consumer” or “User” means any end-user who accesses or uses the Platform to search for and obtain the Services;
2.3 “Consumer Charges” or “User Charges” means charges incurred by Consumers for the Services obtained through the use of the Service, including any applicable tolls, taxes and any other fees or charges that may be due for a particular use of the Service;
2.4. “DUDU” / “DUDU CAR” / “we” means: DUDU CAR SDN. BHD.
2.5. “DUDU CAR Policies” means the following:
2.5.1. the Privacy Policy;
2.5.2. the Driver Code of Conduct or the Consumer Code of Conduct may be applicable; and
2.5.3. all other forms, policies, notices, guidelines, frequently asked questions (FAQs), or agreements provided to or entered into by you from time to time;
2.6. “Personal Data” is any information which can be used to identify you or from which you are identifiable. This includes but is not limited to your name, nationality, telephone number, bank and credit card details, personal interests, email address, your image, government-issued identification numbers, biometric data, race, date of birth, marital status, religion, health information, vehicle and insurance information;
2.8. “Platform” means the Application, Software and any other platform, portal or website which DUDU CAR owns, operates or otherwise makes available to Consumers and/or Drivers for the purposes of or in connection with the Service;
2.9. “Privacy Policy” means our privacy policy accessible on the Application as amended from time to time;
2.10. “Service” means the linking of Consumers to Drivers through the Application, Platform and/or Software;
2.11. “Software” means any software associated with the Application which is supplied made available for download and installation by DUDU CAR;
2.12 “You” refers to the Drivers and/or Consumer as may be applicable.
3. Declarations, Guarantees, and Obligations
3.1. By using the Service and/or Platform, you represent, warrant and undertake that:
3.1.1. You are at least eighteen (18) years old to enter the Agreement.
3.1.2. You agree to use the Application, Platform and Service for their intended and lawful purposes;
3.1.3. You agree to provide us with whatever proof of identity or any other documents, permits, licenses or approvals which we may reasonably request or require;
3.1.4. You agree that only one (1) account can be registered on one device, except as otherwise permitted by DUDU CAR;
3.1.5. You agree to inform us promptly of any unauthorized access to your account or any other security breach;
3.1.6. You agree to keep your account password or any identification we provide you which allows access to the Service safe and confidential;
3.1.7. You agree not to allow anyone else to use your identity or user account, and you may not transfer or assign your account to any other individual or organization;
3.1.8. You agree to comply with all laws applicable to you and/or your use of the Service/Platform;
3.1.9. You agree to provide information that is true, accurate, up-to-date, and not misleading when using the Service. You are also responsible for updating your information as needed to keep it accurate and current throughout the duration of this Agreement. DUDU CAR will rely on the information you provide, and if it is found to be false, inaccurate, misleading, or incomplete, DUDU CAR has the right — though not the obligation — to terminate this Agreement and your access to the Service at any time, with or without notice;
3.1.10. You agree not to disrupt, damage, or interfere with the Service or Platform in any way. In particular, you will not:
(a) send spam or unwanted messages;
(b) share or post illegal, offensive, harmful, or infringing content, including anything that violates the law, third-party rights, or DUDU CAR policies;
(c) send harmful software like viruses or malware;
(d) disrupt or damage the Platform’s operation or data;
(e) attempt to access the Platform, systems, or networks without permission;
(f) pretend to be someone else or misrepresent who you are;
(g) act in any way that could harm DUDU CAR’s reputation;
(h) interfere with how the Platform or its network is meant to function;
(i) use automated tools or scripts (such as bots or crawlers) that overload or disrupt the Platform or try to bypass its structure or security.
3.1.11. You agree not to use any part of the app or platform for business or commercial purposes without our permission. This means you cannot change, copy, share, display, or use any content from the platform in any way for public or commercial use unless DUDU CAR has given you written approval. This includes, but is not limited to:
(a) Create or gather collections or directories from content on the Platform, except for personal, non-commercial use.
(b) Copy content from the Platform or display ("mirror") it on other websites, servers, or devices, including republishing product information or reviews in any form or media.
(c) Use data mining, scraping, or similar methods to collect information from the Platform.
(d) Disassemble, decompile, reverse engineer, or try to extract any code or software from the Platform or its services.
3.1.12 You agree not to use modified devices or apps to bypass security, commit fraud against DUDU CAR, or interfere with the normal operation of the Application.
3.1.13. You agree to give accurate and up-to-date information when using the Service and to keep it updated at all times. DUDU CAR will trust that your information is correct. If your information is false, outdated, or incomplete, DUDU CAR can end this Agreement and stop your use of the Service at any time, with or without notice;
3.1.14. You agree not to use the Application or Software to cause trouble, act inappropriately, or show disrespect toward DUDU CAR or any third party;
3.1.15. You agree not to use the Application to send or store any unlawful material or for fraudulent or illegal purposes;
3.1.16. You agree only use an authorized access point or data account;
3.1.17. You agree that the Service is provided based on reasonable efforts and not guaranteed to be flawless or uninterrupted;
3.1.18. You agree that your use of the Service will be subject to DUDU CAR’s Privacy Policy;
3.1.19. You agree to cooperate with DUDU CAR in any internal or external investigations, as needed, to help DUDU CAR comply with applicable laws and regulations;
3.1.20. You agree to take full responsibility and be liable for any loss or damage caused to yourself, DUDU CAR, or others due to your violation of this Agreement;
3.1.21. You agree to share phone numbers from your contact list with DUDU CAR regularly and confirm that you have permission to do so to help improve your use of the Service; and
3.1.22.You are aware that when requesting Services by SMS or by using the Service or accessing the Platform, standard telecommunication charges will apply.
3.2. If you are a Driver, you further represent, warrant and undertake that:
3.2.1. If applicable, you have a valid driver’s license, a public vehicle service license (PSV), and an e-hailing vehicle permit (EVP). You also have all required licenses, permits, approvals, and insurance needed to provide services in the area where you use the Service;
3.2.2. If applicable, you have a valid liability insurance policy with industry-standard coverage for your provision of the Service(s);
3.2.3. If applicable, you either own or have the legal right to use the vehicle, when providing the Service(s);
3.2.4. You are fully responsible for any claims, liabilities, or damages — including injuries, death, or property loss — caused by the services you provide. The deposit stated in your employment contract may be used to cover minor property damage or any other related claims and liabilities from accidents or losses;
3.2.5. If applicable, you have valid e-hailing insurance as required by law. This insurance must cover vehicle damage, personal injury, consumer death, and third-party claims while you are driving. If applicable, please submit a copy of the insurance to DUDU CAR;
3.2.6. You agree to follow all local laws while providing the Service(s) and are fully responsible for any violations. You also agree that DUDU CAR can check your background at any time to ensure you are not involved in or linked to any criminal activity;
3.2.7. You shall not contact Consumers for purposes other than in relation with the Service;
3.2.8. You must not try to trace, track, or find out personal information about any other users on the Application. This includes trying to access accounts that aren’t yours or using the Application to discover someone else’s personal details. You are only allowed to access and use your own information as provided by the Application;
3.2.9. You understand that any standard telecommunication charges when responding to Consumers are your responsibility and must be paid by you;
3.2.10 You are not allowed to use the Service for anything other than its intended purpose, such as collecting DUDU CAR’s data. Doing so is a serious offense and could be seen as spying or sabotage. DUDU CAR can take legal action against you or anyone telling you to do this;
3.2.11 DUDU CAR reserves the right, at its sole discretion, to not onboard you for any reason or to deny your application; our decision in this matter is final. Furthermore, DUDU CAR retains the right to suspend or terminate your account at any time for any reason, including, but not limited to, violations of these terms, failure to pay fees when due, or any other actions that DUDU CAR deems harmful to the Service or its users;
3.2.12 DUDU CAR has the right to reject your application or choose not to onboard you for any reason, and this decision is final. DUDU CAR also has the right to suspend or terminate your account at any time for reasons such as breaking these terms, not paying fees on time, or doing anything that could harm the Service or its users.
3.3. If you are a Consumer, you further represent, warrant and undertake that :
3.3.1. You may only use the Service for yourself or, if allowed, for someone else who is at least twelve (12) years old (an “Unaccompanied Minor”). If you do so, you are fully responsible for that minor;
3.3.2. You will not use the Application, Platform and/or the Software to cause nuisance, annoyance, inconvenience or make fake bookings;
3.3.3. You shall not contact the Driver for purposes outside the Service;
3.3.4. If required, you agree to provide the correct number of passengers when booking the Service. If this information is false or incorrect, you understand that the Driver can cancel your booking, and you may be charged a Cancellation Fee according to the Cancellation Policy;
3.3.5. You shall not intentionally or unintentionally cause or attempt to cause damage to the Driver and property (vehicle) of DUDU CAR.
4. Device and Browser Compatibility Disclaimer
Different models of routers, browsers, and devices may have settings or firmware that do not work with the Application, Platform, or Software. While we do our best to make them compatible with most common devices and browsers, we cannot guarantee that they will work on every specific mobile device or hardware.
5. License Grant and Restrictions
DUDU CAR grants you a limited, non-exclusive, non-transferable license to use the Application, Platform, and Software for personal use only. You may not modify, copy, distribute, sell, or exploit any part of the Application, Platform, or Software without written permission. Additionally, you are prohibited from reverse-engineering, data mining, or using the service in any unauthorized or harmful way.
6. Payments Terms
6.1 For Drivers
6.1.1 DUDU CAR shall provide the driver with a full-time basic salary, supplemented by bonuses and incentives based on monthly revenue performance. Salary payments will be made at the beginning of each month, using the payment method selected by the driver.
6.1.2 DUDU CAR reserves the right to suspend the processing of any transaction if it reasonably suspects fraud, illegal activity, or any criminal involvement, or if you and/or the Consumer have violated any terms of this Agreement. In such cases, DUDU CAR shall not be held responsible for any withholding, delay, suspension, forfeiture, or cancellation of payments.
6.1.3 DUDU CAR may, at its sole discretion, offer promotions with varying features and rates to Consumers. You agree to honor and comply with these promotional offers as part of providing the Service.
6.2 For Consumers:
6.2.1 Consumers must fully pay for all services using the payment method chosen at booking, either cash or an available online payment option. These payments are final and non-refundable. If DUDU CAR covers any part of these charges on your behalf, you must repay DUDU CAR in the way and time frame specified by DUDU CAR.
6.2.2 Automated payment may be made by credit card and or debit card, e-Wallets or where available by such other methods as are made available in the DUDU CAR Application.
6.2.3 If the tipping feature is available, you may set a default tip amount when registering for the Service. This tip will automatically be added to the Consumer Charges and paid to the Driver after the service is completed, unless you choose to adjust or remove it.
7. Cancellation Terms
7.1 For Drivers:
7.1.1 Consumers depend on you to deliver the Service. You acknowledge that frequently cancelling or ignoring bookings will harm the Consumer experience and damage DUDU CAR’s reputation and brand.
7.1.2 You are allowed to cancel a booking, but only for valid reasons listed in the Application. DUDU CAR may update these acceptable reasons at any time. If you cancel without a valid reason or ignore bookings, it may count against you and could lead to temporary restrictions or even termination on your access to the Service.
7.1.3. You agree to be honest with the cancellation reasons, otherwise, DUDU CAR has the right to terminate or suspend your access to the Service.
7.2 For Consumers :
7.2.1 You may cancel your request free of charge for transportation services 5 minutes after your ride is accepted by the assigned Driver.
7.2.2 If you cancel your booking more than 5 minutes after your ride has started, or if you fail to show up at the pickup location, you may be charged a Cancellation Fee, as outlined in the Cancellation Policy on DUDU CAR’s website.
7.2.3 If you believe you were wrongly charged a Cancellation Fee, you can reach out to DUDU CAR customer service for assistance. DUDU CAR reserves the right to determine whether a refund is granted, and any approved refund may be credited to your payment card, given as DUDU Coins, or provided through another method deemed appropriate by DUDU CAR for cash payments.
8. Ratings and Feedbacks and Complaints
8.1. Consumers and Drivers may be allowed to rate and give feedbacks to each other in relation to Service provided.
8.2. Any disputes or complaints between Drivers and Consumers should be resolved directly between the parties involved.
8.3 All ratings, feedbacks and complaints will be automatically recorded in DUDU CAR’s system and may be reviewed and analysed. Based on these ratings, DUDU CAR reserves the right to take appropriate actions, including suspending your access to the Service, may be without prior notice or compensation.
9. Repair and Cleaning Fees for Consumers
If applicable, you will be responsible for covering the cost of repairing any damage to, or cleaning of, DUDU CAR’s property caused by your misuse of the Service or violation of these Terms of Service. DUDU CAR may process payment for these reasonable costs on behalf of the Driver through your chosen payment method or request the payment from you in cash, once the Driver’s repair or cleaning request has been verified by DUDU CAR.
10. Intellectual Property Ownership
All rights, title, and interest in and to the Application, Platform, Software, and all related content, features, trademarks, logos, and intellectual property belong exclusively to DUDU CAR and its licensors. You agree not to reproduce, modify, distribute, display, or use any of DUDU CAR’s intellectual property without prior written consent. Any unauthorized use may result in termination of your access to the Service and legal action where applicable.
11. Your Content and How We Use It
You can share content on certain parts of the platform. While you still own your content, by sharing it, you:
(a) give DUDU CAR permission to use, store, edit, display, and share your content (including your name and image) anywhere, in any format, for any purpose, without paying you;
(b) confirm you have the right to give us this permission and are responsible for what you share.
We may also use your name and image in advertising or promotions, but we don’t have to.
If you give us suggestions or feedback, we can use them without owing you anything.
You can ask us to remove your content by contacting the DUDU CAR customer service on website or platform.
12. Taxes
You agree that this Agreement is subject to all applicable taxes, fees, and charges as required by law. You will follow all relevant laws and help DUDU CAR claim or verify any tax credits, rebates, or refunds related to taxes paid for the Service.
13. Confidentiality
13.1 You agree to keep all information and data about DUDU CAR — including its services, products, business operations, marketing plans, or any other activities — strictly confidential, whether shared verbally or in writing, before, during, or after this Agreement. You also agree to only use this confidential information for the purpose of using the Service and not share it with anyone else or use it for any other reason without DUDU CAR’s written permission.
13.2. The confidentiality obligations mentioned above do not apply if you can prove that:
13.2.1. you already had the information before receiving it;
13.2.2. the information becomes public knowledge in the future, through no fault or action of yours;
13.2.3. you received the information from a third party who had the right to share it; or
13.2.4. you are legally required to disclose the information.
14. Personal Data Protection and Privacy Policy
DUDU CAR collects and uses your personal information according to its Privacy Policy. This policy applies to all DUDU CAR services and is included as part of this Agreement. Where relevant, you agree and give consent to DUDU CAR, its subsidiaries, and affiliates to collect, use, process, and share your personal data as outlined in our Privacy Policy. You acknowledge that DUDU CAR may share other individuals’ personal data with you while you use its services. You agree and confirm that you will only use this information for the specific purpose it was provided and not for any unauthorized use.
15. Third Party Interactions
15.1. While using DUDU CAR’s services, you may engage with third parties, including advertisers, service providers, or other users. Any interactions, transactions, or agreements you enter into with these third parties are strictly between you and them. DUDU CAR is not responsible or liable for any loss, damage, or issues that arise from these interactions. You agree that DUDU CAR does not endorse and will not be held accountable for any content, products, or services provided by third parties through the platform.
15.2. DUDU CAR may show ads and marketing from third parties in the app to help support or earn extra revenue. You agree to receive these ads. If you don’t wish to, you can follow the steps in our Privacy Policy to unsubscribe or change your privacy settings. You also agree that DUDU CAR can share anonymous information about you and how you use the service in reports or analyses. Lastly, you are responsible for being cautious in any interactions with third parties you come across through the service or their ads.
15.3. We may provide links to other websites or show content from third parties (“Third Party Content”). These are not controlled by us, and we are not responsible for any mistakes, delays, offensive material, or issues you may encounter from them. Linking to these sites doesn’t mean we endorse or verify them, and you use them at your own risk. If you have any questions or concerns about third-party content, please contact our customer service team.
15.4. You acknowledge that the app uses data, as well as search results from Google Maps. By using the app, you agree to follow:

Google’s Acceptable Use Policy (https://cloud.google.com/maps-platform/terms/aup/)
You also agree not to:
(a) Copy, change, reverse engineer, or try to access Google Maps’ source code.
(b) Share, transfer, or distribute Google Maps.
(c) Sell or resell Google Maps as part of a product that doesn’t add value beyond Google Maps itself.
(d) Use Google Maps in any illegal way or in a way that avoids paying Google’s fees.
16. Indemnification
You agree to protect, defend, and hold DUDU CAR, its affiliates, officers, directors, employees, and agents harmless from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to:
Your use of the Service.
Your violation of any terms of this Agreement.
Your violation of any rights of a third party, including other users or Consumers.
Any claim or dispute between you and a third party, including Consumers.
This obligation to indemnify will continue even after you stop using the Service.
17. Disclaimer of Warranties
DUDU CAR provides the Service, Platform, and Application on an "as is" and "as available" basis. We make no warranties or guarantees of any kind, whether express, implied, statutory, or otherwise, including but not limited to:
The accuracy, completeness, reliability, or availability of the Service.
The quality or suitability of the Service for your specific needs.
The continuous, uninterrupted, or error-free operation of the Service.
That the Service, Platform, or Application will be free from viruses, malware, or other harmful components.
By using the Service, you agree that you do so at your own risk. To the maximum extent permitted by law, DUDU CAR disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
18. Disclaimer of Limitations
The Service, Platform, Application, and Software may experience limitations, delays, and other issues that naturally occur with the use of the internet and electronic communications. These issues may also arise from problems with your device or the Driver’s device, including being faulty, disconnected, out of range, powered off, or not functioning properly. DUDU CAR is not responsible for any delays, failed deliveries, damages, or losses that result from these problems.
19. Limitation of Liability
19.1. Unless stated otherwise and to the extent allowed by law, any claim you make against DUDU CAR will be limited to the total amount you paid or owe for using the Service during the event that caused the claim. DUDU CAR and Driver will not be responsible for:
19.1.1. Any loss, damage, or injury related to the Service, Platform, App, or Software;
19.1.2. Problems using or being unable to use the Service, Platform, App, or Software;
19.1.3. Your reliance on the accuracy or completeness of any advertisements;
19.1.4. Any dealings or relationships between you and any consumer, driver, advertiser, or sponsor whose advertisement may appear on the website or is connected to the Service — even if we were told this could happen.
19.2. DUDU CAR does not check or guarantee the safety, legality, ability, or reliability of consumers or partners (including drivers, advertisers, or sponsors). You agree not to hold DUDU CAR responsible for any issues or damages caused by these third parties.
19.3. DUDU CAR is not part of any disputes or negotiations between you and consumers or drivers. Your decisions to use services or buy products through the platform are entirely your responsibility. You release DUDU CAR from any liability or damages arising from your use of the Service or interactions with third-party providers.
19.4. The quality of the services you book is the responsibility of the driver. By using the Service, you understand that you may encounter transportation that is unsafe, offensive, or otherwise unpleasant, and you do so at your own risk.
20. Notifications
DUDU CAR may send announcements or notifications through the app, by email to the address you provided, or by written letter sent via registered mail or prepaid post to the address on file. Notices are considered delivered 48 hours after mailing or posting, or 1 hour after being sent by email. If you need to notify DUDU CAR, you can do so by sending a letter via courier or registered mail to the contact address provided in the app, and it will be considered received once DUDU CAR gets it.
21. Transfer
You are not allowed to transfer or assign these Terms of Service to anyone else without getting written approval from DUDU CAR. However, DUDU CAR can transfer or assign the Terms without needing your permission. Any attempt by you to assign these Terms without approval will be invalid.
22. Governing Law and Dispute Resolution
This Terms of Service is governed by Malaysian law. If there is any dispute or claim related to this agreement or the services, it will be settled through arbitration at the Asian International Arbitration Centre (AIAC) in Kuala Lumpur. The arbitration will follow the AIAC rules, and one arbitrator will be appointed by both you and DUDU CAR. If both parties cannot agree on an arbitrator, the President of AIAC will appoint one. The arbitration will be conducted in English. The cost of the arbitration will be shared equally between you and DUDU CAR, unless the arbitrator decides otherwise.
23. Severability
If any provision of this Terms of Service is found to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be deemed severed from this Agreement, and the remainder of the Terms of Service shall remain valid, binding, and in full force and effect.
24. Relationship
Nothing contained in these Terms of Service shall be construed as creating any agency, partnership, or other form of joint enterprise with DUDU CAR.
25. No Waiver
The failure or delay by DUDU CAR to enforce or exercise any right, remedy, or provision of this Terms of Service shall not be deemed a waiver of such right, remedy, or provision. Any waiver of any right or provision shall only be effective if in writing and signed by an authorized representative of DUDU CAR.
26. Entire Agreement
This Agreement constitutes the entire understanding and agreement between you and DUDU CAR with respect to the subject matter herein and supersedes all prior or contemporaneous discussions, negotiations, representations, or agreements, whether written or oral. No terms, conditions, or representations not expressly set forth herein shall be binding upon either party.
27. Suspension, Modification, and Termination
27.1. You agree that we may, at any time and without prior notice, do the following:
(i) modify, suspend, or end the operation of the Platform or any part of it (including your account access or the availability of services and products) for any reason;
(ii) change our policies or terms; and
(iii) temporarily interrupt the Platform for maintenance, error correction, or other updates. We are not required to compensate you for any such suspension or termination.
27.2. We may also update, modify, or remove content from the Platform without notice. This includes information about product or service availability, descriptions, prices, promotions, or offers. If any content contains mistakes, inaccuracies, or omissions, or does not comply with DUDU CAR Policies, we reserve the right (though not always required by law) to take corrective actions ("Rectification Measures"). These actions may include:
(i) correcting errors;
(ii) updating information; and/or
(iii) cancelling affected bookings at any time, even after a booking has been placed.
27.3 DUDU CAR reserves the right to suspend or terminate your access to the Service, Platform, Application, or your account at any time, without prior notice, if you breach these Terms of Service or if such suspension or termination is necessary for security, legal compliance, or operational reasons.
27.4 Upon termination, all rights granted to you under these Terms of Service will immediately cease, and you must stop using the Service and delete or remove any copies of the Application from your devices.
27.5. You may terminate your account at any time by contacting DUDU CAR through the customer service, provided that all outstanding payments or obligations are settled.
28. No Third Party Rights or Assignment
This agreement does not give rights to any third parties who are not party to this Agreement.
